C. Consumer Protections
C1. Service termination notice. The Agency provides at least 10 calendar days’ advance written notice before terminating services to a consumer, except where the consumer is 14+ days behind on payment despite prior notice, or a direct care worker’s health or welfare is at risk. (§ 611.57(a))
C2. Pre-service information packet. Before service begins, the Agency provides all seven § 611.57(c) items: available services and the assigned worker, hours, fees, the Department licensure contact, the DOH complaint hotline (1-866-826-3644) and local Area Agency on Aging Ombudsman, worker hiring/competency requirements, and the employee-vs-independent-contractor disclosure. (§ 611.57(c))
C3. Prohibited practices. No owner, employee, or affiliated individual may serve as the consumer’s power of attorney or guardian; the Agency does not require a consumer to endorse checks over to it. (§ 611.57(b))
