Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the HomeCare Agency Policieswebsite and the policy-manual and related document services we offer (together, the “Service”), operated by HomeCare Agency Policies(“we”, “us”). By accessing or using the Service, or by placing an order, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
HomeCare Agency Policiesprepares written policy & procedure manuals and related operational documents for non-medical home care agencies, organized to the topics and structure a given state’s home care licensing rules describe. The documents we deliver are self-prepared operational and business documents that you adopt, brand, and submit as your own.
2. Not legal advice; no professional relationship
We are nota law firm and we do not provide legal advice, and using the Service does not create an attorney-client relationship. The Service is not a substitute for advice from a licensed attorney or other qualified professional. You are responsible for confirming your state’s current requirements with the relevant licensing authority and, where appropriate, a licensed attorney, before relying on or submitting any document.
3. Not affiliated with any government agency
We are not affiliated with, endorsed by, or connected to any state department of health, licensing agency, or other government body. Any reference to a state’s requirements, or to a document being “built to” a state’s requirements, describes the structure and topics of the document only. It is not an approval, endorsement, certification, or guarantee by any agency, and it does not mean the document satisfies every requirement applicable to your specific agency.
4. No guarantee of licensure or survey outcome
A policy manual is one part of a license application. We make no representation or guarantee that your license application will be approved or that your agency will pass a licensing survey or inspection. Those outcomes depend on your full application, your actual operations, and the reviewing agency, all of which are outside our control.
5. Your responsibilities & accurate information
The documents we prepare are built from the agency details you supply. You certify that the information you provide is accurate and complete, and you remain responsible for reviewing, adopting, implementing, and following the policies in your own operations. You agree not to use the Service for any unlawful purpose, to misrepresent your agency, or to resell or redistribute the documents as a substantially similar product of your own.
6. Privacy & no protected health information
We store the agency and account details needed to prepare your documents, deliver them, provide support, and bill paid plans. We do not request, and you must not submit, protected health information (PHI) or other patient or client medical records. We do not sell your data.
7. Pricing, payment & made-to-order documents
We offer a one-time State P&P Manual ($149) and a one-time Agency Launch Bundle ($349), and a Policy Updates subscription ($99/year). One-time documents are made to order: they are prepared from the agency details you supply and delivered within 3 business days. The Policy Updates subscription is billed through Stripe on a recurring annual basis until you cancel; you authorize those recurring charges, and you may cancel at any time to stop future charges. Prices and plan features may change for future orders.
8. Refunds
You may request a full refund of a one-time order anytime before your document is delivered, just reply to your order confirmation email. Subscription charges may be cancelled at any time to end future billing; except where required by law, fees already charged for a completed subscription period are non-refundable.
9. Third-party services
Payments are processed through Stripe, and we rely on third-party hosting, email, and infrastructure providers to operate the Service. The Service depends on these providers; we are not responsible for their availability, content, or actions, and your use of them may be subject to their own terms.
10. Intellectual property
The Service, including the site, document templates, and software, is owned by us and protected by applicable law. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use and adapt the documents we deliver for the operation of your own home care agency. The completed documents you receive, as customized with your agency details, are yours to use for that purpose.
11. Disclaimers
THE SERVICE AND ALL DOCUMENTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, or that any document will be accurate, complete, or sufficient for licensure, survey, or any other regulatory purpose.
12. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or denied or delayed licensure. Our total liability arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or US $100.
13. Indemnification
You agree to indemnify and hold us harmless from any claim or demand arising out of your use of the Service, the information you submit, the way you adopt or operate under the documents, or your violation of these Terms or any law or third-party right.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or create risk or legal exposure for us. Sections that by their nature should survive termination will survive.
15. Changes
We may modify the Service or these Terms. If we make material changes, we will update the effective date above and, where appropriate, provide notice. Your continued use after changes take effect constitutes acceptance.
16. Governing law
These Terms are governed by the laws of the United States and the state in which the operator is principally located, without regard to conflict-of-laws rules, and you submit to the exclusive jurisdiction of the courts located there for any dispute arising under them.
